I do not see any illegality in the order impugned more particularly in the background of order dated 09.03.2006 whereby and whereunder the learned lower court has directed the defendant to pay the arrear rent up till the date of the order which had already been deposited.

However, the learned lower court is directed to expedite the trial in the background of the fact that the suit happens to be under personal necessity. Petition is rejected. (Aditya Kumar Trivedi, J) siddharth/- U
