JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for grant of regular bail on behalf of the petitioner who is an accused in connection with Jehanabad PS Case No. 185 of 2015 for the alleged offences punishable under Sections 326, 307, 34 and 120B of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Chief Judicial Magistrate, Jehanabad. Briefly stated, the prosecution case is that the maternal cousin of one Pappu Sharma opened fire upon the informant Upadhyay Yadav, causing injury. Learned counsel for the petitioner submits that the petitioner was not named in the FIR but merely on the basis of suspicion, he was arrested by the police and on the basis of own confessional statement of the petitioner,

Patna High Court Cr.Misc. No.46070 of 2015 (2) dt.13-10-2015 2/2 he has been made an accused.

The petitioner is in custody in connection with the present case since 25.5.2015.

In view of the submission made on behalf of the learned counsel for the petitioner, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in Jehanabad PS Case No. 185 of 2015. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
