1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Kotwa P.S. Case no.76 of 2024 registered under sections 307, 323, 385, 379, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the petitioner demanded rangdari of Rs.5 lacs from the informant and on the informant protesting, he struck him with a glass bottle on his head leading to injuries.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. There is case and counter case between the parties, the correct version having been given in the counter case lodged by the father of the petitioner herein. Patna High Court CR. MISC. No.39882 of 2024(2) dt.04-06-2024 2/2 on the body of the informant have been found to be simple in nature. The petitioner is in custody since 27.3.2024 and has no criminal antecedent.

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., there being case and counter case between the parties, the injuries on the informant being simple in nature and the petitioner having remained in custody since 27.3.2024, the Court directs the petitioner to be enlarged on bail in connection with Kotwa P.S. Case no.76 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari.
