The petitioner apprehends his arrest in Kalyanpur PS case No. 33/2020 registered under Section 304B, 34 of the IPC. The informant alleged that his daughter was married to Pappu Ram, son of the petitioner. The informant got information that his son-in-law was demanding motor cycle as additional dowry and when the demand was not fulfilled he assaulted his wife.

The learned counsel for the petitioner submits that petitioner is father-in-law of the deceased. The informant made specific allegation of demand of motor cycle against the husband of the deceased. The husband of the deceased is in jail. No specific allegation is made against the petitioner. The doctor found one ligature mark around the neck of the deceased and no

Taking into consideration the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is father-in-law of the deceased and the informant did not make any sorts of allegation against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. case No. 33/2020, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
