The petitioner seeks bail in a case registered for the offences punishable under Sections 406 and 409 of the Indian Penal Code.

The Director of Aastha Motors, Patna alleged that Satya Nand the petitioner took the loan amount from the customers from Tata Motors Finance but did not deposit the same. The petitioner is alleged to have misappropriated a sum of Rs. 10 lakhs. It is submitted that Madheshwar Singh lodged Agam Kuan P.S. Case No. 239 of 2014 and made allegation against Binod Kumar Singh and others including the petitioner. The petitioner is simply a clerk and he did not misappropriate any amount. Patna High Court Cr.Misc. No.44148 of 2015 (2) dt.23-09-2015 2/2 it was found that no money was deposited in the loan account of the customers. Madheshwar Singh made specific allegation against Vikash Kumar Singh and the same Vikash Kumar Singh lodged this case against the petitioner in order to save his skin. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, Patna in Agam Kuan P.S. Case No. 238 of 2014.
