JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 This is an application for grant of regular bail in favour of the petitioners who are accused in connection with Chhatapur PS Case No. 52 of 2014 for the alleged offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
The petitioners are the brothers of the husband of the deceased. The deceased was found missing for a few days and her dead body was subsequently found lying in a field. Learned counsel for the petitioners submits that they have been implicated merely on the basis of suspicion that they might be involved in killing of the deceased. He contends that there is absolutely no allegation of any overt or covert act against the petitioners in commission of the offence.

Let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in Chhatapur PS Case No. 52 of 2014.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
