Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 427, 429, 436, 379 of the Indian Penal Code. The prosecution case is that due to previous enmity the First Information Report named accused persons took away two bags of wheat worth Rs.1400/- and put the house of the informant on fire, as a result one she buffalo calf died.
It is submitted by learned counsel for the petitioner that petitioners are brother-in-law of the informant. For a petty dispute, accusation has been levelled. The present petition has not supported the accusation, which reflects from the impugned order.
Patna High Court Cr.Misc. No.3579 of 2016 (2) dt.22-01-2016 Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Saharsa Sadar P.S. Case No. 454 of 2015, pending in the court of learned Chief Judicial Magistrate, Saharsa.
With the above observation this application is disposed of.
