2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 354, 376, 302, 201, 120(B), 504, 506/34 of the Indian Penal Code.
3. This is the second attempt of the petitioner for bail. Earlier, the bail application of the petitioner was rejected by a Co-ordinate Bench of this Court vide order dated 01.02.2023 passed in Cr. Misc. No.36749 of 2022, with an observation to the Trial Court to expedite the trial and conclude the same at the earliest.
4. As per prosecution case, the petitioner committed rape upon the informant on pretext of solemnization of marriage and thereafter, committed murder of the victim.

5. It is submitted by learned counsel for the petitioner that despite the direction of this Court, the trial has not been concluded. Till date six witnesses have been examined, out of which three witnesses have been declared hostile. Petitioner is in custody since 20.02.2022 and has got no criminal antecedents.
6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
7. Considering the nature of accusation, progress of trial, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.
8. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 1st, Bagaha, West Champaran in connection with Mahila (Bagaha) P.S. Case No. 14 of 2022.
