JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 384 and 427 of the Indian Penal Code, sections 3 of Prevention of Damage to Public Property Act and section 40 of Bihar Minor Mineral Concession Rules, 1972.

The prosecution case is that the petitioner was getting the soil cut from the land of parcha holder Mohan Paswan. It is submitted by the learned counsel for the petitioner that aforesaid Mohan Paswan is neither in possession of the land in question nor he has lodged any complaint against the petitioner and only on suspicion the petitioner has been roped in

Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent Considering the nature of accusation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Khagaria (Mufassil) P.S.
