JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 29-09-2022 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Mahila P.S. Case No. 17 of 2019 registered for the offence under Sections 341, 323, 504, 494, 498(A) and 34 of the Indian Penal Code and Section 3 and 4 of D.P. Act.

The accused/petitioner is named in the F.I.R. and is in custody since 28.04.2022.

The allegation against the petitioner is to commit cruelty upon informant along with other family members/co-

No.39692 of 2022(2) dt.29-09-2022 2/3 accused persons for demand of dowry and also alleged to solemnized marriage with another lady without getting dissolution of marriage with informant, in accordance with law. Learned counsel appearing on behalf of the petitioner submitted that allegation of solemnization of marriage with one Priyanka Kumari is completely false and same has been denied also on oath through paragraph no.8 of the present bail petition. It is further submitted that the petitioner is ready to keep the informant/wife with full of her love and dignity. While concluding the argument, it is submitted that investigation of this case has been completed, for which, charge-sheet has already been submitted and as such, there is no chance of tampering with the evidence.

Learned APP duly assisted by learned counsel for the informant, while opposing the prayer of bail, fairly conceded the fact that informant has decided to dissolve her marriage with petitioner.

Considering the facts and circumstances as mentioned above, as informant decided to dissolved her marriage with petitioner coupled with the fact that charge-sheet has already been submitted, let the petitioner, above named, is directed to be released on bail in connection with Mahila P.S. Case No. 17 of

Patna High Court CR. MISC. No.39692 of 2022(2) dt.29-09-2022 3/3 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Nawada/concerned court, subject to the condition as mentioned under Section 437(3) of the Cr.P.C.
