The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304(B)/34 of the Indian Penal Code.

Prosecution case relates to commission of murder of the informant's daughter by administering poison due to nonfulfillment of dowry demand of Rs. 2 lakhs. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is mother-in-law of the deceased due to which she has falsely been made accused in this present case. Petitioner has no concern mess and business of the deceased and was living

Patna High Court CR. MISC. No.59993 of 2022(2) dt.07-02-2023 2/2 separately from deceased and her husband. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. Moreover, similarly situated co-accused persons have already been granted bail by a coordinate bench of this court vide order 11.4.2022 in Cr. Misc. No. 31671 of 2022 and the same has been annexed as Annexure-2. It is further submitted that the petitioner is languishing in judicial custody since 5.5.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Yogapatti (Nawalpur) P.S. Case No. 511 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran.
