Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 354 of the Indian Penal Code, 10 of the Prevention of Children from the Sexual Offences Act and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act.
The prosecution case is of taking the minor daughter of the informant in a cane field and making an attempt to outrage the modesty of the daughter of the informant.
It is submitted by the learned counsel for the petitioner that for the occurrence of 02.09.2015 at 12.00 P.M. the First Information Report was registered on 03.09.2015 at
Patna High Court Cr.Misc. No.6903 of 2016 (2) dt.16-02-2016 4.00 P.M. but the same reached to court of learned Sud Divisional Judicial Magistrate on 07.09.2015 which suggests that First Information Report was registered by ante dating. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Ram Nagar P.S. Case No. 185 of 2015, pending in the court of learned Additional Chief Judicial Magistrate, Bagha, West Champaran.
With the above observation this application is disposed of.
