JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 02-07-2015 The petitioner filed the instant writ petition for quashing order dated 12.7.1997 passed by the Additional Member, Board of Revenue, Bihar, Patna in revision case no. 198/1996 whereby the appellate court reversed the order dated 16.5.1996, passed in Appeal case no. 1 of 1996 and affirmed order dated 12.12.1995, passed by respondent no.5 (LRDC, Rohtas) in case no. 27 and 28 of 1995-96 contained in Annexure 1.

None appeared on behalf of the petitioner as well as on behalf of private respondents. Today no one appears for the petitioner, though counsel for the State and respondents no. 6 and 7 are present.

Counsel for respondents no. 6 and 7 submits that it is stated that the sole petitioner passed away on 10.11.2010.

Patna High Court CWJC No.344 of 1999 (9) dt.02-07-2015 Having regard to the facts and circumstances of the case, this writ petition is disposed of with liberty to the heirs of the petitioner to challenge the impugned order, if so advised afresh.
