The petitioner seeks pre-arrest bail in connection with Bhagwanpur Hat P.S. Case No. 124 of 2015 registered under Sections 406, 420 and 384/34 of the Indian Penal Code. It is contended that the petitioner has admittedly received the amount of Rs. 98,800/-, but he has supplied bricks amounting to Rs. 70,500/- on 28.04.2015, 29.04.2015 and on 30th June, 2015, and has returned the balance amount of Rs. 28,300/-.

Learned counsel for the State has opposed the

Patna High Court Cr.Misc. No.1893 of 2016 (4) dt.11-04-2016 2 / 2 application for grant of pre-arrest bail to the petitioner. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Bhagwanpur Hat P.S. Case No. 124 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
