The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and 34 of the Indian Penal Code and sections 3 and 4 of the D.P Act.
As per the prosecution case, the petitioner who happens to be the husband of the deceased used to abuse and torture the sister of the informant for non-fulfillment of the demand of dowry to the tune of Rs. 5 lacs. She was ultimately done to death.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Contrary to the allegations, the marriage of the petitioner with the sister of the informant took place in the year 2005. There
Patna High Court CR. MISC. No.45570 of 2021(3) dt.28-02-2022 2/2 has been no complaint ever since the marriage. The relationship between the parties were amicable. The allegations of torture and demand of dowry are false and concocted. Petitioner is in custody since 27.1.2021 and has no criminal antecedent.
Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the material that has transpired in course of investigation, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
Liberty is granted to the petitioner to renew his prayer for bail after framing of charge.
