Mr. Pawan Kumar Chaurasia, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 23-06-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Amdanda P.S. Case No. 105 of 2024 dated 20.10.2024 registered for the offences punishable u/s 309(6) of the BNS Act.

3. As per the prosecution case, on 19.10.2024, the informant was coming on his motorcycle from Goradih Block, in the meantime, four persons ridden on a motorcycle stopped the informant's motorcycle and started assaulting him on the point of pistol. Thereafter, they have snatched his ATM card, motorcycle, two mobile phones and Rs. 1,000/- in cash. The accused persons fled away from the spot.

4. Learned counsel for the petitioner has submitted that

The petitioner has been made accused in this case merely on suspicion. It is further submitted that the petitioner has no concern with the alleged recovery. Nothing has been recovered from the conscious possession of the petitioner. No T.I.P has been conducted by the prosecution. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.11.2024.

5. Learned A.P.P. for the State and learned counsel for the informant have opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhagalpur in connection with Amdanda P.S. Case No. 105 of 2024.

7. The application stands allowed.
