Petitioners apprehend arrest in connection with Complaint Case No. 880 of 2016 registered for the offence punishable under sections 498A/379 of the Indian Penal Code and section 4 of the Dowry Prohibition Act. Learned counsel appearing for the petitioners submits that petitioners, who are husband and mother-inlaw of the informant, have been falsely implicated in this case. Petitioners never demanded any dowry from the informant. As a matter of fact, the informant does not want

No.37405 of 2019(4) dt.03-02-2020 2/2 to live with this petitioner and earlier also the petitioner no. 1 had filed Sanha No. 3612 of 2014 before the Chief Judicial Magistrate, Bhagalpur stating apprehension about being implicated in false case by his wife. Petitioner no. 1 is still ready to keep his wife with full honour and dignity. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Banka in connection with Complaint Case No. 880 of 2016 subject to the conditions laid down under section 438(2) Cr.P.C.
