The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Chitragupta Nagar P.S. Case No. 86 of 2025, lodged on 13/08/2025, under Sections 126(2), 118(1), 109, 61(2), 3(5) and 103 of the BNS, 2023 as well as under Sections 27, 25(1-b)A, 26 and 35 of Arms Act, pending in the Court of learned C.J.M, Khagaria.

3. As per the prosecution, FIR has been lodged under

2/4 Sections 126(2), 118(1), 109, 61(2), 3(5), 103 of the BNS, 2023 and under Sections 27, 25(1-b)A, 26 and 35 of Arms Act, in which allegation of murder of the informant's brother has been made.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence and his name is not named in the FIR. Counsel submits that his name is figured by virtue of confessional statement of co-accused. Counsel submits that the petitioner has clean antecedent and is a college going student. He further submits that the petitioner's entire career would be ruined if he is kept in jail. Counsel further submits that co-accused persons have been granted bail by a coordinate Bench of this Court vide order dated 23.03.2026 passed in Cr.Misc Nos. 3592 of 2026, Cr. Misc. No.73212 of 2025 and Cr. Misc. No.73875 of 2025. Counsel further submits that one of the accused person has been also granted anticipatory bail. Counsel submits that the petitioner is in custody since 03/03/2026. Counsel further submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that case diary was called for.

3/4 Counsel submits that it is true that there is no allegation against the petitioner that he has fired any gun shot or he was present on the place of occurrence but it has come in the case diary that prior to commission of the crime all accused persons sat together and in furtherance of their common intention, the petitioner has played the role of liner and he had time to time used to talk and inform on mobile to the killers about the presence of the deceased. Counsel further submits that it is true that the accused Priyansh @ Akash Raj has been granted bail by a Coordinate Bench of this Hon'ble Court vide order 23.03.2026 passed in Cr. Misc 3592 of 2026 having similar allegation as like that of petitioner.

6. In the present facts and circumstances of this case, this Court finds that the said Priyansh @ Akash Raj was apprehended on 08/09/2025 and has been released on bail on 23/03/2026 after about six months whereas the petitioner is in custody since 03/03/2026.

7. Considering the parity, it is directed that the petitioner shall be released only after completion of six months of custody, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned C.J.M, Khagaria

4/4 in connection with Chitragupta Nagar P.S. Case No. 86 of 2025 subject to the conditions as laid down U/s 480(3) of the BNSS, 2023.
