JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner appears to have given repeated Chhevani blows to informant's wife, who sustained altogether three injuries, out of which; one injury was found on her right parital region up to bone deep. The doctor opined the aforesaid injury as grievous in nature but submission on behalf of the petitioner is that the aforesaid injury does not come under the definition of grievous injury because there was neither any bone cut nor there was any fracture.

Considering the above-said submission as well as facts and circumstances of the case and also taking note of this fact that the petitioner is languishing in jail custody since 03-05-2015, let
