Considering that the Petitioners have already surrendered to the Court below under Section 41-A of the Code of Criminal Procedure, this application for anticipatory bail filed on behalf of the Petitioners in connection with Nauhatta P.S. Case No.143 of 2015 pending before the Chief Judicial Magistrate, Saharsa, is not maintainable.
Accordingly, the application is disposed off in terms of the direction given in the case of Mahendra Prasad Singh Vs. State of Bihar [2004(3) PLJR 491].
