JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner and the State. Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 498(A)/34 of the Indian Penal Code and Section 4 of Dowry Prohibition Act. As per the prosecution case, petitioner along with other family members committed torture on the complainant due to non-fulfilment of dowry demand.

Petitioner is the mother-in-law of the complainant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case.

Thrust of allegation is against the husband of the complainant who has already been granted bail. Learned counsel for the State opposed the prayer for pre-arrest bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Patna Sadar, District Patna, in connection with Complaint Case No. 06 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
