JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Rail Bhagalpur P.S. Case No.42 of 2014, disclosing offences under Sections 341, 324 and 307/34 of the Indian Penal Code.
The petitioner is in custody since 25.08.2014. He was not named in the First Information Report. In course of investigation, it transpired, on the basis of
Patna High Court Cr.Misc. No.47514 of 2015 (2) dt.03-11-2015 2/3 statements of some persons before the police, that after the occurrence had taken place, the petitioner and other two persons, namely, Sonu Kumar and Vikash Kumar, were seen fleeing away from the place of occurrence.
Learned counsel, appearing on behalf of the petitioner, submits that under similarly situated circumstance, co-accused, namely, Vikash Kumar @ Uncle, has been granted regular bail by this Court, vide order, dated 10.08.2015, passed in Cr. Misc. No.29588 of 2015. He further submits that petitioner has no criminal antecedent, as has been stated in Paragraph 3 of the application.
In view of the submission, as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional District Judge, Bhagalpur, in connection with Sessions Trial No.744 of 2014, arising out of Rail Bhagalpur P.S. Case No.42 of 2014.
This is subject to the condition that the petitioner shall present himself before the police/Court,
Patna High Court Cr.Misc. No.47514 of 2015 (2) dt.03-11-2015 3/3 as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
