JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Rupauli (Akbarpur) P.S. Case No. 285 of 2014, registered under Sections 302/34 and 392 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. and in course of investigation, the name of the petitioner and Karelal Mandal @ Karuwa @ Shiv Kumar and others have come in the confessional statement of co-accused Chano Mandal and Rajesh Mahto showing the involvement in the present case, except the said confessional statement, there is no material against the petitioner.

Patna High Court Cr.Misc. No.46953 of 2015 (3) dt.12-02-2016 Further submission is that while the petitioner is an accused in one case as detailed in paragraph-03, but he is on bail and in the present case, he is in custody since 26.06.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-1st, Purnia in connection with Rupauli (Akbarpur) P.S. Case No. 285 of 2014 (Sessions Trial No. 393 of 2015).
