In view of the stand taken by the State-respondents in their counter affidavit, learned counsel for the petitioner submits that this writ application may be disposed of with liberty to the petitioner to file an appeal before the District Magistrate, Bhojpur, Ara under Rule 67 of the Mines Rules and if the petitioner files the statutory appeal within a period of six week, the respondent No.4 is directed to dispose of the appeal of the petitioner in accordance with law preferably within a period
