JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Chandi P.S. Case No. 92 of 2019 instituted for the offences punishable under Sections 420, 120B of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 16 litres of liquor from the pickup van and petitioners succeeded in fleeing away from there and it further appears that petitioners have criminal antecedents.

Submission of learned counsel for the petitioners is that they have falsely been implicated on the disclosure made by co-accused.

Patna High Court CR. MISC. No.35720 of 2019(3) dt.13-08-2019 2/2 Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that not only their names have been disclosed by co-accused but they have criminal antecedents also.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioners. If petitioners surrender and pray for regular bail, the same shall be considered and, if possible, to be disposed of on the same day, without being prejudiced by this order. With the above observation, this application is dismissed.
