JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for grant of regular bail on behalf of the petitioner who is an accused in connection with Kadamkuan PS Case No. 158 of 2014 for the alleged offences punishable under Sections 498A. 304B, 201/34 of the Indian Penal Code.

The petitioner is in custody since 26.8.2015. She is mother-in-law of the deceased. Learned counsel appearing on behalf of the petitioner has referred to the allegations made in the First Information Report and has submitted that the allegation of demand of dowry is non-specific and omnibus.

I find substance in the submission of learned counsel for the petitioner. This application is, accordingly,

Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VI, Patna in Sessions Trial No. 554 of 2014 arising out of Kadamkuan PS Case No. 158 of 2014. This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
