2. None appears on behalf of the petitioner despite repeated calls. The petitioner was also not represented yesterday when the matter was called.

Learned counsel for the opposite party appears and opposes the petition submitting that he would equally be put to difficulty if the said restitution case is transferred to Darbhanga as sought on behalf of the petitioner as he is presently posted at Saraiganj, Muzaffarpur being engaged in Banking service.
