The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 504 and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 01.01.2022 at 6:30 pm, Suraj Mandal (petitioner) asked him to give Rs. 5,000/- for celebrating 1st January or he would be shot dead, thereafter Neeraj Mandal started abusing him and when he expressed his inability to pay the money, it is alleged that Neeraj fired at him causing injury on his rib and he fell down.

No.36976 of 2022(2) dt.30-11-2022 2/2 Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that specific allegation of firing is against Neeraj and petitioner has been roped in the present case with a false allegation that he was demanding Rs. 5,000/- for celebrating 1st January.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sabour P.S. Case No. 06 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
