The petitioner seeks bail in Udwantnagar P. S. Case No. 483 of 2018 instituted for the offence under Section(s) 302 and 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

In the written report, It is alleged that on the date of occurrence on the instigation of Bijendra Singh and this petitioner accused persons, namely, Suji Singh, Aditya Singh, Upendra Singh and Gajendra Singh started firing indiscriminately. It is alleged that co- accused Sujit Singh fired shot on the chest of father of informant on account of which he fell down and died on the spot.

Leaned APP after looking into the case diary submits that in the postmortem report only one gun shot injury has been found by the doctor.

As per written report, petitioner is only alleged to have instigated the accused persons.

Petitioner is in custody since 31.1.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Bhojpur at Ara, in connection with Udwantnagar P. S. Case No. 483 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
