The petitioner apprehends his arrest in connection with Mohiuddin Nagar P.S. Case No. 180 of 2018 registered under Sections 147, 447, 341, 323, 324, 307, 354, 379 and 504 of the I.P.C. pending in the Court of A.C.J.M.-III, DistrictSamastipur. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has no criminal antecedent. The present case is lodged only to make undue pressure.

Learned A.P.P. appearing on behalf of the State

Patna High Court CR. MISC. No.35807 of 2019(3) dt.08-08-2019 2/2 opposed the prayer of the petitioner by contending that on perusal of first information report itself, it appears that there is direct allegation of assault by means of Hasua on the head of the informant with intention to kill him. Hence, the petitioner does not deserve the privilege of anticipatory bail. Having considered the above facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail.
