JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 354, 448, 323, 504, 506 and 511 of the Indian Penal Code.
It is alleged that petitioner entered into the house of informant in intoxicated condition and tried to outrage her modesty.
It is submitted by the learned counsel for the petitioner that petitioner is cousin of the husband of informant and due to dispute regarding money transaction the accusation has been made. Moreover, the incident took place on 10.08.2015 at 7 PM but the FIR was lodged on 11.08.2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal

Considering the nature of accusation and relationship between the petitioner and husband of informant, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Muffasil P.S. Case No. 175 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
