The petitioner seeks bail in connection with S.T. No.120 of 2020 arising out of Pirpainti P.S. Case No.272 of 2019, instituted for the offences under Sections 399, 402, 34 of the Indian Penal Code and Section 25(1-b)a/, 26, 35 of the Arms Act.
The learned counsel for the petitioner submits that the petitioner is in custody since 18.12.2019, he is a person with clean antecedent, charge-sheet has been submitted in this case. The allegation is of recovery of a country-made pistol and two live cartridge from the petitioner who was found at the house of Kurshaila Yadav.
The learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.46439 of 2021(2) dt.06-01-2022 2/2 petitioner has falsely been implicated in this case. He was standing near the house of Kurshaila Yadav, he came to be implicated in the present case when the real criminal fled from the place of occurrence.
Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody since 18.12.2019, he is a person with clean antecedent, chargesheet has been submitted in this case, the petitioner, abovenamed, is directed to be released on bail on his furnishing bailbonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Addl. District & Sessions Judge, Bhagalpur, in connection with S.T. No.120 of 2020 arising out of Pirpainti P.S. Case No.272 of 2019.
The application stands allowed.
