JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 07.10.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner along with three other persons were caught by the police and one pistol and two live cartridges were recovered from conscious possession of the petitioner.

Informant levelled allegation against the petitioner that petitioner along with his three associates were making plan for committing dacoity. Police registered case under section 399 read with section 402 of the Indian Penal Code but application of the aforesaid provision appears to be doubtful.

So far as recovery of fire arm is concerned, petitioner remains in jail custody since 30.7.2015 without having any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
