The petitioner seeks bail in Dinara (Bhanas) P. S. Case No. 56 of 2019 instituted for the offence under Section(s) 392,412 of the Indian Penal Code and Section 37© of the Bihar Prohibition and Exercise Act,2016. Learned counsel for petitioner submits that petitioner and informant are personally known to each other. The petitioner has been falsely implicated in this case due to enmity. There is general and omnibus allegation levelled against this petitioner. The other co-accused of this case has already been granted bail by this Court vide order passed in Cr. Misc. no. 39572 of 2019.

No.35765 of 2019(4) dt.09-08-2019 2/3 It is alleged in the written report that while the informant was going with his tractor two persons, namely, Santosh Yadav and Imlesh Yadav gave signal to stop the tractor. The informant stopped his tractor then both persons told that they shall go to Kochas. Since the informant was driver of locality he knew personally both of them. He gave lift to both persons. Thereafter, in the way towards Kochas when the informant reached near Mini Rice Mill both persons told the informant to stop the tractor. As soon as the informant stopped his tractor it is alleged that co-accused Santosh Yadav at the point of pistol took away the money from pocket of the shirt of the informant. The petitioner took money from the back side of pocket of the jeans of informant.

The informant raised hulla then Dinara police came at the place of occurrence. The accused persons fled away towards south Road on seeing the police. The petitioner was apprehended on chase whereas co-accused Santosh Yadav managed to run away. As such mere suspicion has been raised against this petitioner.

Petitioner is in custody since 16.2.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

No.35765 of 2019(4) dt.09-08-2019 3/3 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judgecum Special Judge Excise Rohtas at Sasaram in connection with Dinara (Bhanas) P. S. Case No. 56 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
