The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 379, 411, 341, 323, 353, 307 and 504 of the Indian Penal Code & Section 21 of MMDR Act and Section 56 of B.M.M illegal Transportation & Storage Rules, 2021.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that driver leaving the tractor laden with sand fled, thereafter 30-40 accused came and assaulted the police leading to injuries to several policemen, petitioner along with others was identified by the Chowkidar.
Learned counsel for the petitioner submits that the

No.36660 of 2022(2) dt.30-11-2022 2/2 petitioner has been falsely implicated in the present case, it is next submitted petitioner is neither the owner nor the driver of the alleged tractor as such there was no occasion for the petitioner to reach the place of occurrence, it is next submitted that petitioner has been falsely implicated at the instance of Chowkidar with whom he is on an inimical term. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Fatehpur P.S. Case No. 291 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
