JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with the accusation of participating in the alleged crime but submission on behalf of the petitioner is that the enmity between the petitioner and informant is going on since the year 2004 as the wife of the petitioner had filed CWJC No. 10177 of 2008 against the informant's wife and others for cancellation of her appointment of Shiksha Mitra. It would further contended by him that due to above stated enmity, the informant lodged this false case against the petitioner and moreover, it was other accused, who gave injection to the informant.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.46231 of 2015 (2) dt.01-10-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Khizersarai P.S.Case No. 142 of 2011.
