JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 18.12.2018 in connection with Chapra Town P. S. Case No. 505 of 2017 registered for the offences punishable under Sections 307/34 of the Indian Penal Code.

The first information report goes to show that it was F.I.R named accused Krishna Sah @ Naga Sah, who opened fire on the informant and so far as petitioner is concerned, it is only stated that he was also present with the accused Krishna Sah @ Naga Sah when the occurrence took place. Para-3 of the petition goes to show that petitioner does have criminal history of several cases but learned counsel for the petitioner submits that at Para-8 of the petition, it has specifically, averred that

Patna High Court CR. MISC. No.34537 of 2019(5) dt.20-11-2019 2/2 petitioner was arrested in connection with one case and, thereafter, he was remanded by the police in several cases which has been lodged against the unknown persons.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named, petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Town P.S. Case No. 505 of 2017.
