Mr.Amitesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 325, 379 and some other minor Sections of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence while the informant went to see his field all the accused persons, including this petitioner, threatened the informant to transfer his land in their name otherwise they would forcibly take the possession of the land. On protest, all the accused persons abused the informant with filthy language and assaulted him and also took Rs. 150/- from his pocket. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. From perusal of the FIR it appears that land dispute is
Patna High Court CR. MISC. No.46507 of 2021(3) dt.05-07-2022 2/2 genesis of the occurrence. The allegation is general and omnibus. Allegation u/s 379 of the IPC is superficial. Petitioner has got clean antecedent.
Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Nawada in connection with Warisaliganj PS case No.41/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
