22-01-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Sindhawalia P.S. Case No. 26 of 2021, Trial No. 05 of 2021, registered for the offence under Section 25(1-b)a / 26 of the Arms Act and Section 8(c) / 20(b)(ii)(B) of the N.D.P.S. Act.

One loaded country-made pistol, one live cartridge and one mobile phone have been recovered from the possession of the petitioner.

It is submitted on behalf of petitioner that no narcotic drug has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent and is in custody since 19.01.2021. Chargesheet has already been submitted.

Patna High Court CR. MISC. No.46366 of 2021(2) dt.22-01-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-1 cum Special Judge (NDPS), Gopalganj in connection with Sindhawalia P.S. Case No. 26 of 2021, Trial No. 05 of 2021.
