JUSTICE ALOK KUMAR SINHA ORAL ORDER 07-07-2026 Heard learned counsel for the petitioner, learned counsel appearing for respondent- Lalit Narayan Mithila University, Darbhanga and learned counsel for Chancellor of University.

2. With the consent of the parties the present writ application is disposed of at this stage.

3. In the present writ application the petitioner has prayed for the grant of following reliefs:

"(i) For issuance of direction/order or writ in the nature of mandamus commanding the concerned Respondent Authorities to make payment of arrears of salary

2/4 with penal interest in favour of the Petitioner as per his entitlement from 08.06.2020 to 15.11.2020, while discharging his duties in the capacity of financial advisor of the Respondent University, which was incorrectly/ wrongly disbursed to him ever since his initial appointment without there being any just and valid reason.

(ii) For issuance of writ of mandamus directing the Respondent University to fix the salary as per the pay allowance allowed to previous Financial Advisors of the University and also per the as clarification of the Education Department issued in 2024.

(iii) For issuance of direction to the Respondent No. 2 and 3 to instruct the Respondent No. 5 to carry out the direction in regard to Petitioner in reference to Letter No.

LNMU-06/2026-496/GS(I) dated 19.03.2026.

(iv) Issuance of direction holding the action of the part of the Respondent Authorities in not making the payment to the Petitioner for the tenured posting of 3 years as Financial Advisor. Financial Advisor as Respondent No. 1 and 2 contents of accepted fully the Notification dated 15.11.2020 is wrong and biased, therefore re-appointed the Petitioner again vide Notification dated 02.08.2023.

(v) For issuance writ in the nature of mandamus to direct the Respondent to expunge and false the baseless allegations against the Petitioner as is being stigma on him.

(vi) For any other order or orders as your Lordships may deem fit and proper in the facts and

After advancing some argument, learned counsel for the petitioner submits that for seeking the aforesaid relief, the petitioner is prepared to file a fresh representation before the Vice Chancellor of Lalit Narayan Mithila University, Darbhanga and he, therefore, prays that if such a representation is filed, an appropriate direction be given to the Vice Chancellor of Lalit Narayan Mithila University, Darbhanga to dispose of the said representation within a fixed time frame, after giving an opportunity of hearing to the petitioner.

5. To the aforesaid prayer being made by learned counsel for the petitioner, learned counsel appearing for respondents-University and the Chancellor of the University do not have any objection.

Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a fresh representation before the Vice Chancellor of Lalit Narayan Mithila University, Darbhanga within one month from today. If such a representation is filed, the same shall be disposed of within a further period of three months from the date of receipt of the representation, after giving an opportunity of hearing to

Needless to emphasize that the final order which shall be passed should be a reasoned and speaking order and in case the petitioner is found entitled to the relief, which the petitioner would be claiming through the representation, the same should be extended to the petitioner within a further period of three months from the date of passing of the final order.
