Petitioner apprehends her arrest in connection with Special Case No. 340 of 2017, arising out of Vigilance P.S. Case No. 77 of 2017 registered for the offences punishable under Sections 420, 467, 468, 471, 472, 477A, 120B of the Indian Penal Code and Section 13(1)(d) of Prevention of Corruption Act. Allegation against the petitioner and other accused persons is of making illegal appointment of Panchayat teachers and petitioner happens to be Block Pramukh at that time. Submission of learned counsel for the petitioner is that she himself moved the Tribunal that a fake list was prepared and the same was quashed at the instance of the Tribunal but later on

Patna High Court Cr.Misc. No.18370 of 2018 (3) dt.25-04-2018 2/2 appointment has been made and, as such, petitioner herself challenged the old list and for that she is not responsible and petitioner is lady aged about 50 years.

Heard learned counsel for the Vigilance Department, who has opposed the prayer for anticipatory bail stating that charge sheet has already been submitted against the petitioner. Having heard both sides and in the facts and circumstances, let petitioner surrender in the court below within a period of four weeks from the receipt of this order and on her so surrendering she shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance-I, Patna, in connection with Special Case No. 340 of 2017, arising out of Vigilance P.S.Case No. 77 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that petitioner shall co-operate in investigation and appear before the Investigating Officer as and when required.
