2. The petitioner seeks bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S..

3. As per prosecution case, informant alleged that there was a dispute with regard to illicit liquor and a number of persons, including this petitioner, had threatened him and in the morning, dead body of son of informant, namely Amresh Kumar, was recovered. Informant suspects that all the F.I.R. named accused persons, including this petitioner, killed son of informant.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in

Patna High Court CR. MISC. No.35286 of 2026(2) dt.03-07-2026 2/2 this case. Informant is not an eye witness to the occurrence and petitioner has been made an accused in this case merely on suspicion. Similarly situated co-accused persons have already been granted bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 19.03.2026 passed in Cr. Misc. No. 3578 of 2026. Petitioner has got no criminal antecedents and he is in custody since 19.11.2025. Moreover, charge-sheet has already been submitted.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstance of the case, general and omnibus nature of accusation, claim based on parity, clean antecedents of the petitioner and period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.1st Class, Munger in connection with Harpur P.S. Case No. 75 of 2025.
