JUSTICE SANJAY PRIYA ORAL ORDER 25-06-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Islampur P.S. Case No. 412/2018, instituted for offences under Section(s) 147, 148, 149 and 302 of the Indian Penal Code read with Section 27 of Arms Act.

It is alleged in the written report that on the date of occurrence this petitioner and other accused persons surrounded the father of informant. It is further alleged that co-accused Mukesh Kumar fired shot on the chest of father of informant, who died in the way to hospital.

From the written report it appears that there is direct and specific allegation of causing firearm injury to the father of informant against co-accused Mukesh Kumar. Petitioner is

Patna High Court CR. MISC. No.37590 of 2019(2) dt.25-06-2019 2/2 alleged to be member of unlawful assembly, who had surrounded the father of informant.

Learned counsel for the informant has opposed the prayer for bail.

Petitioner is in custody since 25.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Islampur P.S.
