The petitioner is accused in connection with Barahara (Sinha O.P.) P.S. Case No. 171 of 2015 registered under Section 304(B)/34 of the Indian Penal Code. The accusation is of killing of Priti Kumari, daughter of informant by burn caused by her husband and other in-laws of the family due to non-fulfillment of demand of dowry. Learned counsel appearing on behalf of the petitioner submits that petitioner happens to be the husband of the deceased. Further submission is that, in fact, due to hot talk in between the petitioner and his deceased wife Priti Devi, she committed suicide by burn and information regarding the
Patna High Court Cr.Misc. No.46926 of 2015 (3) dt.15-02-2016 2/2 occurrence was given to the informant, father of the deceased, but due to some ulterior motive the present case has been lodged with false allegation of causing the dowry death. Further submission is that the Police submitted chargesheet U/s 306 of Indian Penal Code and witnesses in paragraph 20, 21 and 27 of the case diary have also stated about committing suicide by the deceased due to quarrel. The petitioner is in custody since 07.06.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in connection with Barahara (Sinha O.P) P.S. Case No. 171 of 2015.
