This is an application for grant of anticipatory bail in connection with Birpur P. S. Case No. 109 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code. As per the FIR, informant saw the petitioner and other accused persons coming out of the room and when the informant entered into that room he saw his grandson lying dead in the said room. Informant suspects that the petitioner and other accused persons have killed his grandson. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case only on suspicion. Informant is sister of father of the petitioner(Fua) and there is old land dispute between them. During investigation none of the neighbours have claimed to have seen the occurrence. It is

Learned counsel for the State opposes the prayer for bail submitting that during investigation, witnesses have supported the prosecution case.

Considering the fact that during investigation, witnesses have supported the prosecution case, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
