The petitioner has prayed for regular bail in a case instituted for the offence under Sections 364, 365 and 120B of the Indian Penal Code.

As per prosecution case, the informant solemnized marriage of his daughter with co-accused Madhu Yadav and his daughter gave birth of a child, but the child not survived. The informant alleged that petitioner and co-accused Madhu Yadav demanded informant's Aadhar Card and rupees two lacs for purchasing a tractor, but he did not give the same due to his poor economic condition. It is further alleged that due to this, the petitioner along with others killed the daughter of the informant

Patna High Court CR. MISC. No.36617 of 2023(2) dt.04-07-2023 2/2 and disappeared her dead body.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. Petitioner is the father-in-law of the deceased. He submitted that the petitioner has no concern with mess and business of the deceased as well as her husband. He is languishing in judicial custody since 09.11.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 834 of 2022.
