Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 452, 376/511 of the Indian Penal Code.

The prosecution case is that on 26.08.2015 at about 1.00 A.M. in the night, the petitioner entered into the house of the informant and outraged the modesty of the informant.

It is submitted by the learned counsel for the petitioner that even assuming the accusation no offence under Section 376/511 is made out. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Due to petty dispute the accusation has been levelled and there is no medical examination of the informant.

Patna High Court Cr.Misc. No.3888 of 2016 (2) dt.27-01-2016 The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bihta P.S. Case No. 694 of 2015, pending in the court of learned Additional Chief Judicial Magistrate, Danapur, Patna. With this observation this application is disposed of.
