JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-02-2023 This revision application has been filed against order dated 21.02.2017 passed in Matrimonial Case No. 123 of 2011 by the Principal Judge, Family Court, Bhojpuar, Ara whereby, the learned Principal Judge has directed the petitioner to pay Rs. 5,000/- per month to the opposite party No. 2 (wife of the petitioner) as maintenance allowance besides payment of arrears in six installments within a period of six months from the date of filing the maintenance petition.
It is submitted by learned counsel for the petitioner that the petitioner is unemployed and he is not in a financial condition to pay the amount of maintenance allowance so fixed by the Court below.
Perusal of the impugned order goes to show that after taking into consideration the entire materials available on
Patna High Court CR. REV. No.336 of 2017(2) dt.24-02-2023 2/2 record, the Court below has passed the order of maintenance allowance. The monthly maintenance allowance of Rs. 5,000/- per month to opposite party No. 2 (wife of the petitioner) in this age of high inflation cannot be said to be excessive or onerous. In view of the facts and circumstance as mentioned in the impugned order, I do not find any illegality or irregularity in the impugned order.
I do not find any merit in this application. This criminal revision application is, accordingly, dismissed. (Prabhat Kumar Singh, J) Navya/- U T
