The petitioner seeks bail in a case registered for the offences punishable under sections 341, 323 and 302 of the Indian Penal Code.
Prayer for bail of the petitioner was earlier rejected by order dated 20.03.2015 passed in Criminal Misc. No. 3854 of 2015 with an observation that the petitioner may renew his prayer for bail after remaining in jail custody for one year. It is submitted that the petitioner is in jail since 26.09.2014 i.e. for more than 14 months. The allegation against the petitioner is that he assaulted the deceased with lathi, although there is no eye witness of the occurrence.
Considering the facts aforesaid, petitioner is
Patna High Court Cr.Misc. No.49511 of 2015 (2) dt.16-12-2015 directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S.
