The petitioners seek bail in connection with Chakiya (Mahila) P.S. Case No.38 of 2015 registered under Sections 370 and 366(A)/34 of the Indian Penal Code besides Sections 3/4/6 of the Protection of Children from Sexual Offences. The accusation is that the father of the informant, Sanju Kumari, who used to sexually assault her, in spite of protest made by her, talked to sell her to the petitioners for the purpose of marriage on 27.05.2014.
Having regard to the facts and the circumstances of the
Patna High Court Cr.Misc. No.48100 of 2015 (2) dt.30-10-2015 2/2 case, the petitioners, above named, are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge at Motihari, East Champaran, in connection with Chakiya (Mahila) P.S. Case No.38 of 2015. Out of the two sureties, one surety of the petitioner no.1, must be his close relative, who will file an affidavit giving genealogy as to how he/she is related with the petitioner no.1, whereas out of the two sureties, one surety of the petitioner no.2 must be local.
